These Terms of Use (“Terms”) govern your use of the Frigate Outfitters website (the “Site”). Frigate Outfitters is a brand of Maho Apparel, LLC (“Maho Apparel,” “we,” “us,” “our”). By accessing or using the Site, you agree to these Terms.

1) Use of the Site

You agree to use the Site only for lawful purposes and not to:

• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to the Site or systems
• Interfere with the Site’s operation or security
• Submit false or misleading information

2) Orders, Custom Products, and Artwork

Most items are made to order and/or customized. When you place an order, you agree that:

• You are responsible for providing accurate information (sizes, shipping address, customization selections).
• Artwork fees are non-refundable. We provide unlimited revisions to get your boat artwork exactly how you want it prior to production.
• Colors and placement may vary slightly due to screen settings, printing methods, and product materials.

3) User Submissions and Uploaded Images

If you upload images, logos, or other content:

• You represent that you own the rights or have permission to use and submit the content.
• You grant Maho Apparel a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the content as needed to create proofs, produce your order, provide customer support, and for marketing purposes as needed.
• You understand we may store artwork files to support reorders and account access.

4) Pricing and Payments

Prices and availability may change without notice. Taxes and shipping charges are shown at checkout. Payments are processed through third-party payment processors subject to their terms.

5) Shipping and Delivery

Delivery estimates are not guaranteed. Risk of loss generally passes to you upon delivery to the shipping address provided, unless otherwise required by law.

6) Returns and Refunds

Returns and refunds are governed by our Return Policy. Due to the custom nature of our products, refunds are only granted for material defects or production errors identified upon delivery and reported within the required timeframe, subject to eligibility requirements.

7) Intellectual Property

All content on the Site, including logos, designs, text, graphics, and images (excluding your uploaded content), is owned by Maho Apparel or its licensors and may not be used without permission.

8) Disclaimer of Warranties

The Site and products are provided “as is” and “as available,” to the fullest extent permitted by law. We disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

9) Limitation of Liability

To the fullest extent permitted by law, Maho Apparel will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, arising from your use of the Site or purchase of products. Our total liability for any claim will not exceed the amount you paid for the product(s) at issue.

10) Indemnification

You agree to indemnify and hold harmless Maho Apparel from claims arising out of your breach of these Terms, your misuse of the Site, or your uploaded content.

11) Governing Law and Venue

These Terms are governed by the laws of the State of Connecticut, without regard to conflict of laws principles. Any disputes will be brought in state or federal courts located in Connecticut, unless otherwise required by law.

12) Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on the Site with an updated effective date.
